THIS IS A LEGAL AGREEMENT BETWEEN YOU AND Boletoguru AND ITS SUBSIDIARIES AND AFFILIATES ("Boletoguru") AND SHOULD BE READ CAREFULLY.

BY ACCESSING THE TRAVEL WEBSITE, YOU ARE INDICATING YOUR ACCEPTANCE OF THESE TERMS OF USE.

YOU AGREE THAT ANY DISPUTE REGARDING THESE TERMS OF USE OR THE TRAVEL WEBSITE WILL BE RESOLVED IN SAN DIEGO, CALIFORNIA, REGARDLESS OF YOUR PLACE OF RESIDENCE OR BUSINESS LOCATION.

Boletoguru may, at any time, modify the Travel Website, including deleting or discontinuing any content or feature of the Travel Website (b), any fees or penalties for using the website, (c), and the Terms of Use. Your continued use of the Travel Website will be subject to the Terms of Use and validity at the time of use.

SYSTEM ERROR

In the event of a system error regarding the price of flights, hotels, car rentals, and any other reservations available on Boletoguru, Boletoguru reserves the right NOT to sell the reservation at the erroneous price.

Once the system error has been identified, Boletoguru will notify you of the correct price. At the same time, Boletoguru will not require you to purchase the erroneous reservation at the amended price.

THIRD-PARTY SERVICE PROVIDERS

Certain products, services, and content available on the Travel Website are provided by third parties (the "Service Providers"), including but not limited to airlines, hotels, car rental agencies, cruises, guided tour operators, insurers, and other travel or travel service providers. Additionally, some software and data found on the Travel Website are copyrighted and owned by the Service Providers and/or third-party providers and distributors.

RELATIONSHIP

No joint venture, partnership, employment, agency, or fiduciary relationship exists between you and Boletoguru as a result of using our services, including the Travel Website. In our role as travel agents and providers of the Travel Website, Boletoguru acts as an independent contractor. Boletoguru assists you in finding travel providers and is diligent in meeting your individual needs. We consider various factors in identifying travel providers that suit you and in recommending specific itineraries. We want you to be aware that certain providers pay us commissions, as well as incentives for achieving sales goals and other targets, and may occasionally provide incentives to our travel consultants. Some providers may also compensate us for various marketing and administrative services provided, such as granting them access to our marketing channels, participating in marketing programs, and supporting technological initiatives. In addition to this, we may also receive compensation from providers when customers use various forms of payment for products and services. From time to time, we may engage in other business relationships with providers, and these agreements, including receiving levels and types of compensation and incentives, are subject to change. When identifying providers and recommending itineraries, we consider a number of factors, including provider availability, customer preferences, and any agreements we have to book travel in accordance with company travel policies. The relationships we establish with providers can also influence the providers we identify and the itineraries we recommend.

USE OF THE TRAVEL WEBSITE

You may also use the travel website solely for legitimate reservations and purchases and must not use the Travel Website for other purposes, including making any fraudulent, false, or speculative reservations, or any pre-booking on demand. You may not use a robot, "spider," or other automated mechanism, program, algorithm, or methodology with a similar process or any monitoring process manual or copy any of the web pages, data, or content found on the Travel Website, (b) or link to any portion of the Travel Website without the prior written permission of Boletoguru, (c) or use the travel website in violation of or to violate any law, rule, or regulation, (d) or "frame," "mirror," or otherwise incorporate any part of the Travel Website into another website without the prior written authorization of Boletoguru.

You acknowledge and agree that you will not use, nor allow the use of, the travel website in conjunction with any other business activity by any other individual residing, staying, or accessing the travel website from a country prohibited under the regulations of the U.S. Office of Export and/or Foreign Asset Control, including, but not limited to, sanctions-based regulations, country programs against embargoes. You specifically agree to indemnify and hold Boletoguru and the Service Providers harmless from any breach of the "Use of the Travel Website" section.

PURCHASE TERMS

Separate terms and conditions dictated by the respective Service Provider will additionally apply to your reservation and purchase of products and services on the Travel Website. You agree to comply with these terms and conditions, including payment of all amounts due in accordance with the applicable policies of the Service Provider, as well as rules and restrictions related to rate availability, products, and services. You understand that any violation of some of the terms, conditions, policies, rules, or restrictions of the Service Provider may result in the loss of any money paid for a reservation or purchase, (b) cancellation of your reservation or purchase, (c) denial of access to certain flights, hotels, or other products and services, (d) and Boletoguru debiting your account for any costs incurred by Boletoguru as a result of such violation. You understand and acknowledge that you will be responsible for all charges, penalties, duties, taxes, and assessments arising from the use of the Travel Website.

AGE AND RESPONSIBILITY

You represent that you are of legal age to use the Travel Website and to create legally binding obligations for any legal risk you may incur as a result of using the Travel Website. You agree to supervise all use of the Travel Website by minors accessing your account using your name. You also warrant that all information provided by members of your household in using the Travel Website is true and accurate. You understand that you are responsible for all uses of the Travel Website made by you and by those who use your account under your name. GOVERNING LAW

These Terms of Use are governed by the laws of the State of California, USA, without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Diego County, California, USA, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

TRAVEL TO CERTAIN DESTINATIONS

While most travel, both domestic and international, is completed without incident, travel to some destinations may pose more risks than others. Boletoguru urges users of the Travel Website to review current travel advisories, warnings, and restrictions issued by the government of the United States before booking any travel. Additionally, passengers are responsible for determining and obtaining the appropriate documentation for international travel destinations.

WHEN OFFERING TRAVEL TO PARTICULAR DESTINATIONS, Boletoguru DOES NOT REPRESENT OR WARRANT THAT TRAVELING TO SUCH DESTINATIONS IS SAFE, ADVISABLE, OR FREE OF RISKS, AND IT SHALL NOT BE LIABLE FOR LOSSES OR DAMAGES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

TRANSMISSION OF PERSONAL DATA

You acknowledge and agree that by providing personal information to Boletoguru through the Travel Website or by booking or purchasing products and services, you consent to Boletoguru sharing certain necessary information with Service Providers to complete the transaction you have requested. INDEMNIFICATION

You shall defend and indemnify Boletoguru and any Service Provider and their respective parents, subsidiaries, affiliates, and each of their officers, directors, employees, and agents from and against any claims, causes of action, or demands (including reasonable legal and accounting fees) brought by third parties as a result of your (customer's) use of the Travel Website.

COPYRIGHT/TRADEMARKS

The trademarks, logos, and service marks ("Marks") displayed on the Travel Website are owned by Boletoguru and the Service Providers. All information and content, including any software or programs available on or through the Travel Website ("Content"), is protected by copyright.

GENERAL

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. If any provision of these Terms of Use is held to be or becomes invalid, illegal, void, or unenforceable, then such provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of any remaining provisions.

CHARGEBACKS AND CREDIT CARD DISPUTES

The customer agrees not to dispute the processing fee, airfare charge, or fare adjustment. If Boletoguru complies with the terms and conditions of the airlines, as well as this agreement.

If you made a reservation with Boletoguru and did not receive notification or ticket issuance, it is your responsibility to contact us.

If you need to investigate any charges on your credit card, please call or email us at hola@boletoguru.com before disputing the charge with the credit card company. If the customer attempts a chargeback on a non-refundable airline ticket, service fee, or fare adjustment that complies with the airline's terms and conditions, as well as this agreement, the customer agrees to refund the full amount of the chargeback, plus a $250 inconvenience and accounting fee. In cases where the customer attempts a fraudulent chargeback, the customer will be responsible for the cost required to initiate legal proceedings to recover the potential loss imposed by the customer.

Upon cancellation of transportation or travel services, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously disclosed and agreed upon with transparency and meticulousness and accepted by the passenger, all sums paid to the travel seller for travel services not provided will be promptly paid to the passenger, unless the passenger advises the travel seller in writing, after cancellation. This provision does not apply where the travel seller has remitted the payment to another registered wholesale seller of travel, carrier, without obtaining a refund, and where the wholesaler or provider fails to provide the agreed-upon service or transportation. In this situation, the travel seller must provide the passenger with a written statement, accompanied by bank records, establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that payment.

CALIFORNIA RESIDENTS

This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) IF the travel seller was registered and participated in the "TCRF" at the time of sale and the passenger is located in California at the time of payment. Passengers who qualify may file a claim with the "TCRF" if the passenger is owed a refund or more than $50 in transportation or travel services, which the travel seller failed to forward to the appropriate provider or if such money was not refunded to you when required. The maximum amount paid by the "TCRF" to any passenger is the total amount paid by the passenger to the travel seller, not to exceed $15,000. A claim must be filed with the "TCRF" within 12 months after the scheduled trip end date. A claim must include sufficient documentation to prove your claim and the $35 processing fee. Claimants must agree to waive their rights to other civil remedies against the registered participating travel seller for matters arising out of the sale for which you filed with the "TCRF."
